Prince Edward Island

The Prince Edward Island Human Rights Act (PEIHRA) sanctions discrimination in the following areas: accommodation, employment, rental or sale of real property, membership in professional or trade associations, publications, broadcasting, public exhibitions, advertisements, publicly available services and facilities, and volunteer work.

The Prince Edward Island Human Rights Commission (Commission) is an independent agency responsible for the administration and enforcement of the Act. The Commission's mandate includes education, investigation, complaint handling and advice.

What are the prohibited grounds of discrimination? Age, colour, creed, disability, ethnic or national origin, family status, gender expression, gender identity, marital status, political belief, race, religion, sex, sexual orientation, or source of income.

What are the time limits for filing a complaint? A complaint must be made in writing within one year of the day the alleged violation of the BPCIA occurred.

What is the procedure? The Commission may decide to accept or reject the complaint following a preliminary investigation. It will then give the alleged discriminator an opportunity to respond in writing. The Commission may encourage negotiation.

What compensation can you get? A letter of apology, a letter of commendation, an information session on the PSDPA, monetary compensation for injury to dignity and feelings, lost wages and expenses incurred as a result of the discrimination, reinstatement to a job and/or the service or accommodation originally denied.
