The Nunavut Human Rights Act (NHRA) sanctions discrimination in the following areas: employment, organizations and associations, goods, services, facilities or contracts, tenancy and publication.

The Nunavut Human Rights Tribunal (Tribunal) deals with allegations of discrimination or harassment by an individual, business, agency or government.

What are the prohibited grounds of discrimination? Race, colour, ancestry, ethnic origin, citizenship, place of origin, creed, religion, age, disability, sex, sexual orientation, gender identity, gender expression, marital status, family status, pregnancy, lawful source of income and a conviction for which a pardon has been granted.

What are the time limits for filing a complaint? All complaints must be filed within two years of the date of the incident.

What is the procedure? Once a complaint is filed, it is reviewed to ensure that it is complete. The respondent must then respond to the complaint filed. The Tribunal will then review the application to determine whether to dismiss the complaint or proceed with the case. Mediation is encouraged if the complaint proceeds to the next stage, otherwise the matter will proceed to a hearing.

What compensation can you get?  If the Tribunal decides that discrimination or harassment has occurred, there are different forms of orders that can be made: pay the victim compensation for the discrimination or harassment; stop the prohibited behaviour or prevent it from happening again; set up a large-scale program to deal with the discrimination; issue an apology; or implement any other remedy that the Tribunal believes is fair.
